Subject of the contract

These General Conditions govern the purchase of products, made remotely via telematic network, from Annamaria Calzature & Accessori di Daniele Romani - VAT/Tax Code 01449150554 Registered Office: Centro comm. CESURE Via Rossini 8 CAP 05100 Terni (TR) Tel 0744276302 and owner of the website www.annamariacalzature.it.
These general supply conditions apply in full to every order, unless specific written exemptions are sent by Annamaria Calzature to the Customer.
Placing an order implies full acceptance of these general sales conditions.

Prices

The prices indicated on all pages of our website are VAT included
Prices do not include shipping (free in Italy on orders over €69.99) except in cases where expressly indicated.
Prices do not include any customs duties which will be borne by the customer.
For each item, the full price and any discounted price are indicated.

Orders

Orders will be accepted for the minimum and maximum quantities indicated (only where specified).
For each order placed, confirmation via email from annamariacalzature.it will be required.

The merchandise available ONLINE is always available in our warehouses; nevertheless, there could be a remote possibility of simultaneous sale on other marketplaces, in which case we reserve the right to inform the customer of unavailability.

Purchase method

The Customer can purchase any product present on annamariacalzature.it.

The image of a product may not be perfectly representative of its characteristics but may differ in color, dimensions, accessory products present in the figure. All information supporting the purchase is to be understood as simple generic informational material, not referable to the actual characteristics of a single product.

The correct receipt of the order is confirmed by annamariacalzature.it through a response via email, sent to the email address provided by the Customer. This confirmation message will include an 'Order Number', to be used in any further communication with annamariacalzature.it. The message reproduces all data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.

In case of unavailability of the product in question and/or impossibility of accepting the order, annamariacalzature.it guarantees prompt communication to the Customer always via email.

Right of withdrawal

Pursuant to art. 52 et seq. of Legislative Decree 206 of 2005, if the customer is a consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity) they have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty. You may exercise the RIGHT OF WITHDRAWAL OR RECONSIDERATION by first contacting us via our WhatsApp service at number 3534618311 and then returning the purchased product at your expense WITHIN 14 DAYS from the date of receipt, after authorization following the submission of photos demonstrating the integrity of the product as received (PHOTOS OF SOLE, UPPER AND BOX) to the following address:

The right of withdrawal is however subject to the following conditions:

• the right applies to the purchased product in its entirety; it is not possible to exercise withdrawal on only part of the purchased product;
• the purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, placing it in a second box, bearing the RMA number (return authorization code); in all cases, avoid placing labels or adhesive tape directly on the original product packaging;
• the shipment, until receipt is confirmed in our warehouse, is under the complete responsibility of the customer;
• in case of damage to the item during transport, annamariacalzature.it will notify the customer of the occurrence (within 5 working days of receiving the item in its warehouses), to allow them to promptly file a complaint against the courier they chose and obtain reimbursement of the item's value (if insured); in this event, the product will be made available to the customer for its return, simultaneously canceling the withdrawal request;

annamariacalzature.it is not responsible in any way for damage or theft/loss of items returned with uninsured shipments;

upon arrival at the warehouse, the product will be examined to evaluate any damage or tampering not resulting from transport. If the packaging and/or original wrapping are damaged, annamariacalzature.it will deduct from the refund due a percentage, in any case not exceeding 10% of the same, as a contribution to restoration costs.

Subject to any restoration costs for verified damage to the original packaging, annamariacalzature.it will refund the customer the amount already paid (if the Customer does not decide to purchase goods of equal value), in the shortest possible time and in any case within 14 days of the withdrawal request, through a reversal procedure of the amount charged to the Credit Card or by Bank Transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN Code of the invoice holder).

The right of withdrawal lapses totally, or determines a decrease in the value of the item, due to lack of the essential condition of integrity of the item (packaging and/or its content), in cases where annamariacalzature.it verifies:

• the absence of the outer packaging and/or original inner wrapping
• the absence of integral elements of the product (accessories, manuals, parts, etc.)
• damage to the product for reasons other than its transport

In case of lapse of the right of withdrawal, annamariacalzature.it will return the purchased item to the sender, charging them the shipping costs. In case of merchandise exchange, €7.90 will be charged for the double shipping operation.

RETURN AND EXCHANGE COSTS

RETURNS - Returns are at the customer's expense except in case of defect, product not conforming to description and any error attributable to annamariacalzature.it

N.B.
Refunds for orders paid via NEXI method require up to 10 working days from the request.
In case of return made beyond the allowed time of 14 days, the refunded amount will be reduced by 20%

It will be possible to request pickup at home via our partner courier at the price of €7.90 which will be deducted from the refund.
In case of an order with shipping paid by the buyer under €69.99 or cash on delivery, the shipping cost will not be refunded but only the product cost will be credited.

EXCHANGES - Size exchanges (if the required size is available in our warehouse) are free for orders delivered in Italy and only if the product to be replaced costs more than €69.99.

Order cancellation

The customer can cancel the order by simply communicating via email to the address info@annamariacalzature.it, provided that it has not yet been processed.

Late cancellation

If the cancellation should occur after the shipment of the goods, the customer will still be required to receive the goods, subsequently requesting authorization for return.

If the customer who had requested and obtained payment for the goods by cash on delivery should cancel the order after the shipment of the goods, they will be required in any case to receive the goods, immediately requesting return and refund of the amount paid.

In this case, the return is not to be considered free and shipping and return costs will be charged. Upon receipt of the goods, only the product cost will be refunded.

Liability

The buyer with the order assumes responsibility for compliance with legal and safety regulations relating to the use of the purchased products.
Therefore, any liability of the Supplier is excluded for any and all direct or indirect damage caused to persons or property by improper use of the supplied products.
The Supplier in no case can be held responsible, even indirectly, for the non-functioning or insufficient functioning of the products and/or consequent damages.

The sales contract between the Customer and annamariacalzature.it is deemed concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of their municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Terni.
